Welcome to Gluten App (also known as Gluten.App), a service operated by Flappd Tech Inc. ("Gluten App," "Flappd," "Company," "we," "us," or "our").

These Terms of Use ("Terms") govern your access to and use of our website, related web-based services, and all content, features, products, and functionality made available through https://gluten.app and its subdomains (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

The Service is intended only for individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old and legally capable of entering into a binding agreement.

We do not knowingly permit use of the Service by minors.

Gluten App is an informational, discovery, review, listing, and commerce platform designed to help users browse, search, save, review, and interact with gluten-related and related dietary, hospitality, business, product, and place information.

The Service may include, without limitation:

• public and private listings • search and discovery features • favorites and saved preferences • public ratings, reviews, comments, and other user-generated content • business profiles, owner notes, and listing-related information • claim, verification, and representative submission tools • newsletters, marketing, and support communications • digital products, physical products, memberships, subscriptions, premium features, or other paid offerings • location-based features • future features, services, and tools that we may add, change, suspend, or remove at any time

Some features, products, services, or memberships may be available only in selected geographic regions.

Gluten App is an informational and discovery platform only.

We do not manufacture food, prepare food, control restaurant operations, inspect kitchens, supervise staff, control ingredients, guarantee menus, or ensure that any business, location, product, or listing is safe for any particular individual.

You are solely responsible for independently verifying all information that matters to you, including:

• ingredients • allergens • gluten-free claims • cross-contact or cross-contamination risk • preparation methods • product formulations • menu changes • staff knowledge • operating practices • accessibility, availability, or suitability

This applies even where content is marked or described as Verified, Owner, Admin Note, Flappd, or similar. Such labels are informational only and do not constitute a guarantee, certification, endorsement, medical recommendation, safety assurance, or promise of ongoing accuracy.

Information may change at any time due to business changes, operational changes, staff error, supplier changes, user error, stale content, human error, technical error, or other causes. Your reliance on any listing, review, note, business submission, or other content is entirely at your own risk.

Gluten App does not provide medical advice, nutritional advice, diagnosis, treatment, emergency guidance, or professional healthcare advice. Always use your own judgment and consult qualified professionals where appropriate.

Some features of the Service require an account.

You agree to:

• provide accurate, current, and complete information • keep your login credentials secure • keep your account information updated • be responsible for all activity occurring under your account • notify us promptly of any unauthorized use or suspected security issue

We may refuse registration, reclaim usernames, suspend access, or require identity or account verification where reasonably necessary.

The Service may permit you to submit, post, upload, transmit, save, or otherwise make available content, including reviews, ratings, photos, comments, listings or listing edits, profile information, saved preferences, messages or support submissions, business-related materials, and other content or materials.

Content you submit to the Service may be public or made public, depending on the feature and your settings. Publicly visible content may include username, display name, profile photo, city and country, reviews, ratings, photos, comments, and dietary or similar information you choose to display publicly.

You are solely responsible for any content you submit, upload, publish, or otherwise make available through the Service.

You must not submit content that is confidential, deceptive, unlawful, infringing, defamatory, abusive, threatening, discriminatory, harassing, obscene, invasive of privacy, misleading, or otherwise objectionable.

A. Our Rights in the Service

The Service, including its design, layout, trademarks, branding, software, databases, features, text, graphics, compilations, interfaces, and other content created by or for us, is owned by or licensed to Flappd Tech Inc. and is protected by applicable intellectual property and other laws.

Except as expressly permitted by us in writing, you may not copy, reproduce, distribute, modify, sell, lease, reverse engineer, create derivative works from, or exploit the Service or any portion of it.

B. Content Submitted by Users, Owners, and Representatives

By submitting, uploading, posting, sending, or otherwise providing any content, media, images, photos, menus, descriptions, data, notes, edits, business materials, or other materials to or through the Service ("Submitted Content"), you represent and warrant that you own the Submitted Content or have all rights necessary to provide it, the Submitted Content does not violate any law or the rights of any person, and the Submitted Content is accurate to the best of your knowledge.

To the maximum extent permitted by applicable law, you hereby irrevocably assign to Flappd Tech Inc. all right, title, and interest you may have in and to Submitted Content, including all intellectual property rights therein. To the extent any such assignment is not effective, you grant to Flappd Tech Inc. and its affiliates an irrevocable, perpetual, worldwide, royalty-free, fully paid, sublicensable license to use, host, store, reproduce, publish, distribute, adapt, modify, create derivative works from, and otherwise exploit the Submitted Content for any lawful business purpose.

We are not obligated to use, preserve, return, credit, compensate, or keep any Submitted Content.

The Service may allow business owners, employees, agents, or other representatives to claim, verify, submit, edit, or manage business information.

If you submit business information or participate in a claim or verification process, you represent and warrant that you are authorized to act on behalf of the relevant business, the information you provide is accurate and not misleading, and you have the right to submit any materials you provide.

Any claim, verification, owner label, or similar designation is informational only. It does not mean that Gluten App has certified, guaranteed, monitored, or endorsed the business, listing, product, or safety practices.

We are not liable for any changes, inaccuracies, omissions, or outdated information relating to business listings or verification status.

You agree not to:

• use the Service in violation of any law or regulation • submit false, misleading, or fraudulent reviews, ratings, or claims • impersonate any person or entity • submit content you do not have the right to use • misrepresent gluten-free practices, ingredients, or business identity • harass, abuse, threaten, or harm others • upload or transmit viruses, malware, or harmful code • interfere with or disrupt the Service or its infrastructure • scrape, crawl, or extract content without our prior written consent • use the Service or its content to train AI or machine learning models without our prior written consent • generate or submit deceptive, spam, or AI-generated content intended to mislead users or businesses • circumvent access controls, rate limits, or feature restrictions

We may investigate violations and take any action we consider appropriate.

Your use of the Service is also subject to our Privacy Policy and our cookie and privacy-choice controls, each as updated from time to time.

By using the Service, you acknowledge that we may collect, use, disclose, and otherwise process personal information as described in our Privacy Policy.

The Service may include links to or integrations with third-party websites, services, tools, payment processors, mapping services, or other third-party services.

We do not control and are not responsible for third-party services, including their availability, content, terms, or privacy practices. Your use of third-party services may be subject to separate terms between you and the applicable third party.

Certain features of the Service may require payment, including memberships, subscriptions, premium access, digital products, physical products, or other offerings.

By purchasing a paid offering, you agree that you will pay all fees and charges disclosed at checkout, you authorize us and our payment processors to charge your selected payment method, and prices, plans, and availability may change at any time.

Refunds: Unless otherwise required by applicable law, digital access, memberships, subscriptions, and other digital products are non-refundable. Physical products may be subject to separate fulfillment, shipping, return, or replacement policies. For concerns, contact support@gluten.app.

We may change, suspend, limit, remove, or discontinue any part of the Service at any time, with or without notice.

We do not guarantee that any feature, content, listing, membership, or aspect of the Service will always be available, accurate, current, complete, secure, or error-free.

Any beta, preview, experimental, or early-access features are provided "as is," may contain errors, and may be modified or removed at any time.

We may, at our sole discretion and without liability to you, suspend, restrict, remove, edit, or terminate your account, access, submitted content, or any listing, claim, or feature for any reason we reasonably determine appropriate, including suspected violation of these Terms, fraud, safety concerns, security issues, infringing claims, platform integrity concerns, or operational reasons.

You may stop using the Service at any time. Public reviews, listings, historical records, or other content may remain available or retained after account closure or deletion.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

FLAPPD TECH INC. DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, AVAILABLE, CURRENT, COMPLETE, OR ERROR-FREE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT OR GUARANTEE: the accuracy or completeness of listings, reviews, or verification labels; the safety or suitability of any food, business, service, product, or listing; the absence of allergens, gluten, contamination, or cross-contact risk; or the continued availability of any business, feature, or content.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLAPPD TECH INC., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SERVICE, ANY LISTING, REVIEW, VERIFICATION LABEL, BUSINESS SUBMISSION, OR USER CONTENT, ANY DECISION YOU MAKE BASED ON THE SERVICE, OR ANY FOOD, PRODUCT, PLACE, BUSINESS, OR THIRD-PARTY SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF FLAPPD TECH INC. FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF: THE TOTAL AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.

You agree to defend, indemnify, and hold harmless Flappd Tech Inc., its affiliates, directors, officers, employees, contractors, agents, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or relating to: your use of the Service, your Submitted Content, your violation of these Terms, your violation of any law or the rights of any person or entity, or your misrepresentation, negligence, misconduct, or fraud.

These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

You agree that any dispute will be brought exclusively in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Your continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with any additional terms, policies, checkout terms, or product-specific terms that apply to the Service, constitute the entire agreement between you and Flappd Tech Inc. regarding the Service.
